Establishment of the PCCP : The PCCP, which is under the supervision of
the Department of Civil Rights Protection and Legal Aid (CPLA), was established
by the Order of the Office of the Attorney General (OAG) No. 251/2548 dated 2
June 2548.
Rationale and Necessity : One of the main functions of the OAG is to
protect civil rights, liberties and public interest including providing legal
aid and advice to people according to the Ministerial Regulation for
Organization of the Office of the Attorney General 2546 B.E. (2003) Article 3
(24). Nowadays, there are a number of Thai people living and working abroad.
Many of them are laborers working in construction and as housemaids. Some are
restaurant owners and some are married to foreigners. Some of them have
faced legal problems, for example, the problem of legal acts and contracts
signed with labor agents, the problem of family rights after getting married to
foreigners, problems with employers while working abroad, and particularly the
problem of being prosecuted abroad.
Sometimes foreign travelers and
foreigners who live in Thailand encounter legal problems and need legal advice.
As Thailand is committed under international rules and conventions on civil
rights, the OAG has the duty to protect the rights and interests of the Thai
people both in Thailand and abroad. With concern to these crucial problems,
the Attorney General has accordingly issued the above-mentioned Order to set up
the PCCP.
Authorities and Functions : Providing legal knowledge, answering
inquiries and providing legal advice to Thai nationals abroad in the form of law
clinics in many foreign countries where a number of Thai nationals are
residents. Answering questions in relation to laws via the internet to Thai
nationals abroad, as well as to foreigners residing in Thailand. Acting as a
law clinic in Thailand where foreigners are able to walk in and ask for legal
advice.
Cooperating with the Ministry of Foreign Affairs, providing legal
assistance to Thai nationals being prosecuted in foreign jurisdiction.
Protecting the rights of the Thai nationals, both residing in Thailand and
foreign countries, as well as protecting the rights of foreigners residing in
Thailand in accordance with International Human Rights Law. Ways and
